TERMS OF USE
1. INTRODUCTION
1.1 These Terms of Use (“Terms”) govern access to and use of the E‑Tendering Portal operated by Katraj Dairy (Pune Zillha Sahakari Dudh Utpadak Sangh Limited.) (“Katraj Dairy”, “we”, “our”, or “us”) through its official website www.katrajdairy.com (“Portal”).
1.2 By registering, accessing, or submitting any bid or tender on this Portal, each user (“Bidder”, “Vendor”, or “you”) agrees to comply with and be bound by these Terms and any supplementary guidelines, notices, or circulars published by Katraj Dairy from time to time.
1.3 These Terms are applicable to all tenders, bids, quotations, and procurement processes conducted electronically by Katraj Dairy. Use of the Portal signifies acceptance of these Terms.
2. DEFINITIONS
2.1 For the purpose of these Terms:
2.1.1 “Bid” refers to the proposal, quotation, or offer submitted by a registered Bidder in response to a tender published by Katraj Dairy.
2.1.2 “Bidder” or “Vendor” means any person, firm, or company that registers and participates in electronic tenders through this Portal.
2.1.3 “Tender Document” refers to the set of instructions, specifications, and terms issued by Katraj Dairy for participation in a specific procurement process.
2.1.4 “Digital Signature Certificate (DSC)” refers to an electronic key used to authenticate the identity of a Bidder and validate tender submissions.
2.1.5 “User Account” means the unique online account assigned to a registered Bidder for accessing the Portal.
2.1.6 “Working Day” means any day other than Saturday, Sunday, or a public holiday observed in Maharashtra, India.
3. ELIGIBILITY AND REGISTRATION
3.1 Access to the E‑Tendering Portal is permitted only to registered users who meet eligibility criteria prescribed by Katraj Dairy for each tender.
3.2 Registration requires submission of valid credentials, organizational documents, and contact details. Katraj Dairy reserves the right to verify submitted information before activating access.
3.3 The Bidder shall ensure that its account credentials and DSC are used only by authorized personnel. Unauthorized or fraudulent use may result in immediate suspension of access.
4. RESPONSIBILITIES OF BIDDERS
4.1 The Bidder agrees to:
4.1.1 Submit complete and accurate information in all tender-related documents.
4.1.2 Review all tender instructions, specifications, and timelines before submission.
4.1.3 Maintain confidentiality of login details and digital signatures.
4.1.4 Comply with all applicable laws, regulations, and procurement guidelines.
4.2 The Bidder is solely responsible for any errors or omissions in the data submitted.
5. TENDER SUBMISSION AND EVALUATION
5.1 All tenders shall be submitted electronically through the Portal in the prescribed format and within the stipulated deadline.
5.2 Once submitted, no modification or withdrawal shall be allowed unless explicitly permitted under tender conditions.
5.3 Bids received after the due date shall be rejected automatically by the system.
5.4 Katraj Dairy reserves the right to evaluate, accept, or reject any bid, in whole or in part, without assigning reasons.
5.5 The evaluation process may include technical and commercial scrutiny as detailed in the respective tender documents.
6. CONFIDENTIALITY AND INTELLECTUAL PROPERTY
6.1 All data, documents, and materials available on the Portal are the intellectual property of Katraj Dairy (Pune Zillha Sahakari Dudh Utpadak Sangh Limited.). Unauthorized reproduction, distribution, or use is prohibited.
6.2 Bidders shall maintain strict confidentiality of all tender information obtained through the Portal and shall not disclose it to third parties without written consent from Katraj Dairy.
6.3 Any software, system, or platform used in connection with the Portal shall remain the property of Katraj Dairy or its technology partners.
7. PROHIBITED CONDUCT
7.1 The Bidder shall not:
7.1.1 Upload false, misleading, or fraudulent information
7.1.2 Attempt to interfere with or disrupt the functioning of the Portal.
7.1.3 Use unauthorized means to access or copy tender data.
7.1.4 Engage in collusive bidding, price manipulation, or unethical practices.
7.2 Any violation of these prohibitions may lead to permanent debarment or legal proceedings.
8. LIABILITY AND INDEMNITY
8.1 Katraj Dairy shall not be liable for any loss, delay, or error arising due to system failure, internet connectivity, or other technical issues beyond its control.
8.2 The Bidder agrees to indemnify and hold harmless Katraj Dairy, its officers, and employees from any claims, liabilities, or damages arising from misuse of the Portal or breach of these Terms.
9. TERMINATION OF ACCESS
9.1 Katraj Dairy reserves the right to suspend or terminate any Bidder’s access without prior notice if it reasonably believes that the Bidder has violated these Terms or engaged in fraudulent activity.
9.2 Upon termination, all rights and privileges granted under these Terms shall cease immediately.
10. GOVERNING LAW AND DISPUTE RESOLUTION
10.1 These Terms shall be governed by and construed in accordance with the laws of India.
10.2 Any disputes arising under or related to these Terms shall be subject to the exclusive jurisdiction of the competent courts at Pune, Maharashtra.
11. AMENDMENTS
11.1 Katraj Dairy reserves the right to amend or revise these Terms periodically.
11.2 The latest version shall be posted on the Portal, and continued use shall constitute acceptance of such updates.
